Focus
Trade-remedy investigations can materially affect importers, exporters, manufacturers and other participants in international commerce. We advise clients on WTO and Indian anti-dumping law and on related trade-remedy measures, including countervailing duties and safeguards.
Our practice includes assessing trade-remedy exposure and advising on legal and commercial considerations relevant to pricing and market strategy. We assist clients in preparing for proceedings and responding to measures initiated by the designated authority, the Directorate General of Trade Remedies (DGTR).
We advise on the filing of and response to anti-dumping petitions, new exporter and shipper review applications, legal analysis, preparation of complaints, settlement negotiations and preparation of legal and factual submissions. We also assist with oral submissions before the designated authority.
Representative matters include an anti-dumping petition concerning imports of seamless pipes and tubes from China, leading to the initiation of an investigation, and an anti-dumping investigation concerning imports of hydrogen peroxide from Bangladesh, Taiwan, Korea, Indonesia, Pakistan and Thailand.
Because trade-remedy proceedings involve both legal and factual questions, our approach considers the underlying transaction, commercial structure, market circumstances and regulatory framework together, so that the legal position is developed with attention to the wider commercial consequences of the proceeding.
